Almost everybody says they are fine at the scene. It is the most natural thing in the world to say, and it is the sentence that gets read back later.

'I told them I was fine'

Serving Centerville and the surrounding Montgomery County area from our nearby Dayton office.

At the roadside, most people are embarrassed, shaken and mainly concerned with whether the car will move. Asked how they are, they say they are fine, because that is what people say.

Two days later the neck will not turn. A week later the headaches start. Three weeks later an MRI shows a disc that is not where it should be.

None of that is unusual and none of it is inconsistent, but the record now contains a statement that says you were fine, and it will be quoted. Adrenaline masks a great deal at the time, soft-tissue injuries commonly take days to declare themselves, and concussion is frequently not recognized at the scene by anybody present, including the person who has it.

The practical answer is not to lie at the roadside. It is to get seen promptly, to describe symptoms honestly at every appointment rather than minimizing them, and to understand that the gap between the crash and the first medical visit is the thing an insurer will build its argument on.

Claims in Centerville

Centerville is an affluent suburb, and the pattern here is a familiar one: people who are insured properly, who are inclined to be reasonable at the roadside, and who say they are fine before anybody knows whether they are.

Centerville is in Montgomery County. A claim that does not settle is heard at the Montgomery County Court of Common Pleas at 41 N. Perry Street in Dayton, in the Montgomery County Courts Building.

Being reasonable early does not extend anything. Ohio generally allows two years from the date a personal injury claim arises to file it (Ohio Revised Code § 2305.10), however long the treatment turns out to take. General information about the law, not advice about your situation.

Social Security hearings for this area are held by the Dayton Office of Hearings Operations, at Courthouse Plaza SW, Suite 300, 10 North Ludlow Street, Dayton, OH 45402. Its telephone number is 888-450-4590 and its fax is 833-635-0630.

Workers compensation appeals for this area are heard by the Industrial Commission of Ohio at 1242 E Dayton Yellow Springs Rd, Fairborn, OH 45324, telephone 937-264-5116.

Questions

Questions from Centerville

General information, not legal advice. Every case turns on its own facts. The only way to know where yours stands is to have someone look at it.

I said I was fine at the scene. Have I ruined it?

No. It is what nearly everybody says and it is explainable, particularly where the medical records show symptoms developing in the ordinary way. What matters far more is what you did next: whether you got seen, and whether you described the symptoms accurately once you had them.

I did not go to hospital that day.

Very common, and not fatal. Go now rather than deciding it is too late, and say when the symptoms actually started rather than rounding it to the day of the crash. An accurate account is easier to defend than a tidy one.

How long do symptoms usually take to show?

That varies too much by injury and by person for a page like this to put a number on, and a number here would be worth less than a proper examination. What is consistent is that a delay of days is ordinary rather than suspicious.
