Why the insurance company calls so quickly

Serving West Chester and the surrounding Butler County area from our nearby Hamilton office.

West Chester is a commuter township. People here drive for a living or drive to get to work, and the collisions that follow are ordinary highway and arterial crashes: rear-end impacts in slowed traffic, side impacts at busy intersections, and the pile-up that happens when one driver stops late.

What follows those crashes is almost always the same sequence, and it starts faster than people expect. An adjuster calls within a few days. They are friendly, they are sympathetic, and they would like a recorded statement and a signed medical release while you are still sore and still shaken.

That call is early for a reason. It happens before anyone knows how badly you are hurt, which is the cheapest moment in the life of a claim. A back injury that turns out to need surgery costs the same to settle in week one as a bruise does, if you settle it in week one.

Claims in West Chester

West Chester is the largest township in Ohio, and the weight of I-75 commuter traffic through it decides the shape of what happens here: impacts at speed, multiple vehicles, and a good many drivers who live somewhere else entirely.

That volume does not change the venue. A Butler County claim is heard at the Butler County Court of Common Pleas at 315 High Street in Hamilton, inside the Government Services Center.

Deadlines are worth watching closely in a township this size, because an insurer’s early approach can absorb months before anyone notices. Ohio generally gives two years from the date the claim arises for a personal injury action (Ohio Revised Code § 2305.10), and two years from the date of death where someone has been killed (§ 2125.02). General information, not advice on your situation.

Social Security hearings for this area are held by the Cincinnati Office of Hearings Operations, in the John W. Peck Federal Building at 550 Main Street, Cincinnati, OH 45202. Its telephone number is 877-405-7672 and its fax is 833-619-0569.

Workers compensation appeals for this area are heard by the Industrial Commission of Ohio at 125 E Court St, Unit 600, Cincinnati, OH 45202, telephone 513-357-9750.

Questions

Questions from West Chester

General information, not legal advice. Every case turns on its own facts. The only way to know where yours stands is to have someone look at it.

The adjuster wants a recorded statement. Should I give one?

Speak to somebody first. You are not required to give a recorded statement to the other driver’s insurer, and the questions in one are built to produce answers that limit the claim: how fast were you going, are you feeling better, did you go to hospital that day. Saying “I am a bit better” three days in is a sentence that gets read back months later.

They have already offered me money. Is that good?

It is good for them. An early offer is made before the medical picture is known, and accepting it closes the claim for everything that comes afterwards, including treatment nobody has recommended yet. It costs nothing to have the offer looked at before you decide.

I only feel stiff. Is it worth a call?

Yes, and particularly then. Soft-tissue and disc injuries commonly take days or weeks to declare themselves, and the gap between the crash and the first appointment is the thing an insurer uses to argue the two are unrelated. Getting seen is the practical advice; the legal part can wait a few days.
