From the first day I spoke with Mr Steve Casper he was certain we would win my case. He gave me all the confidence that I needed. It's been a long journey but well worth it. We made it and with a win!! Mr Steve Casper is amazing. Ben his assistant is very nice and very knowledgeable too.

Sooner or later somebody on the other side will send you to a doctor of their choosing. It is a normal part of these cases and it is not a medical appointment in the way you are used to.

The examination the other side arranges
Serving Xenia and the surrounding Greene County area from our nearby Dayton office.
Xenia is the Greene County seat, an older town with a mixed population and a long memory, and the cases that come from here span all three of the areas this office works in.
What they have in common at some stage is an examination arranged and paid for by the other side. In a workers compensation claim the employer or the bureau can require one. In a disability claim the agency can send you to a consultative examination. In an injury claim the insurer can ask for one once a case is far enough along.
These appointments look like medical appointments and they are not. The doctor is not treating you, will not be treating you afterwards, and is producing a report for somebody else. They can be short. People come out of a fifteen minute appointment assuming it went fine and are surprised by what the report says.
None of that makes them something to fear. It makes them something to arrive at prepared: describe a normal day rather than your best one, do not push through the movements to be polite, and write down afterwards how long it lasted and what was actually examined.
The cases we handle here
All three can involve an examination arranged by somebody other than you. The pages behind these links explain each process in full.
Claims in Xenia
Xenia is unusual on this list in one respect: the county courthouse is here rather than somewhere you would have to travel to. The Greene County Court of Common Pleas sits at 45 N. Detroit Street in Xenia, and it is where a Greene County injury or workers compensation case is heard if it gets that far.
Most do not. An injury claim is usually resolved with an insurer, and a disability claim is federal and has nothing to do with the county court at all, which is why a local courthouse matters less to these cases than people expect.
Where a personal injury claim does have to be filed, Ohio generally allows two years from the date it arises (Ohio Revised Code § 2305.10). General information about Ohio law, not advice on your own facts.
Social Security hearings for this area are held by the Dayton Office of Hearings Operations, at Courthouse Plaza SW, Suite 300, 10 North Ludlow Street, Dayton, OH 45402. Its telephone number is 888-450-4590 and its fax is 833-635-0630.
Workers compensation appeals for this area are heard by the Industrial Commission of Ohio at 1242 E Dayton Yellow Springs Rd, Fairborn, OH 45324, telephone 937-264-5116.

Questions from Xenia
General information, not legal advice. Every case turns on its own facts. The only way to know where yours stands is to have someone look at it.
Do I have to attend the examination they arranged?
Generally yes, and refusing without a good reason causes more problems than attending. What you can do is understand what it is for, prepare properly, and make sure somebody records what happened at it afterwards.
The examination lasted ten minutes and the report says I am fine.
That happens often enough to be a pattern. A short examination is itself worth documenting: how long it took, what was and was not examined, whether anybody watched you walk. It is one piece of evidence and it can be answered with your treating records.
Should I say I am having a good day?
Be accurate rather than stoic. Most people play it down out of habit, and an examiner records what you say. Describe an ordinary day, including the things you have stopped doing, rather than the day you are having because you made an effort to get there.
