They are a fantastic group of people that care about their clients. I had the most wonderful experience with them. They helped me with my case and they are super professional but also a balance of lovely compassionate people. Steven and Ben are so sweet and always helped me when I had any questions or paperwork with no judgment.

A collision in a parking lot has no police report, no citation and often no independent witness. It is still a claim, and it is proved differently.

The crash that happened in a parking lot
Serving Springdale and the surrounding Hamilton County area from our nearby Cincinnati office.
Springdale is a retail and commercial hub on the I-275 corridor, which means an unusual share of its driving happens off the public road: parking lots, drive aisles, service roads and loading areas.
Collisions there follow a different pattern. Police frequently will not attend a private property crash, so there is no report. No citation is issued, so there is no official finding about who was at fault. The other driver is apologetic at the scene and considerably less so a week later, and nobody took a photograph because it seemed minor.
That absence of paperwork is what insurers lean on, and it is the reason these claims are refused more often than they should be. Fault in a lot is still fault: who had right of way in the aisle, who was reversing, who was moving through a marked lane.
What replaces the police report is what you gather yourself. Photographs of both vehicles and their positions, the lot itself and its markings, the name and number of anybody who stopped, and whether the premises has cameras, which is worth asking about the same day because the footage does not keep.
The cases we handle here
A parking lot collision is the first of these. Being hurt while working in one is the second.
Claims in Springdale
The retail corridor also produces a second kind of claim, because the people working in it are on their feet, lifting, and moving stock in the same lots the collisions happen in. Those are workers compensation matters.
Springdale is in Hamilton County, and a claim that reaches court is heard at the Hamilton County Court of Common Pleas at 1000 Main Street in Cincinnati, in the Hamilton County Courthouse.
Ohio generally allows two years from the date a personal injury claim arises to bring it (Ohio Revised Code § 2305.10). The absence of a police report does not shorten that and it does not mean there is nothing to bring. General information about Ohio law, not advice on your own facts.

Questions from Springdale
General information, not legal advice. Every case turns on its own facts. The only way to know where yours stands is to have someone look at it.
The police would not come out. Do I still have a claim?
Yes. Police often do not attend collisions on private property, and their absence is not a finding that nothing happened or that nobody was at fault. It means the evidence has to come from elsewhere, which is why photographs and names taken at the scene matter so much here.
There were no witnesses.
Ask about cameras, and ask quickly. Retail premises commonly have them covering their lots and the footage is usually overwritten within days or weeks. A request made in the first week is worth more than a lawyer’s letter in month three.
We exchanged details and they seemed reasonable.
People often are at the scene and their insurer is a different matter entirely. Report it to your own insurer regardless, and do not rely on an informal agreement to sort it out privately. That arrangement falls apart more often than it holds.
