The one place where age helps you

Serving Kettering and the surrounding Montgomery County area from our nearby Dayton office.

A great deal of the disability work that comes out of a settled residential community involves people who are not young, have worked all their lives, and have reached the point where the body will not do the job any more.

People in that position often assume age counts against them. The opposite is closer to the truth.

The rules recognize that somebody who has spent thirty years doing physical work cannot simply be retrained into something sedentary at fifty-eight, and they take age, education and the skills a person actually has into account when deciding whether there is other work they could realistically move to. The older the claimant and the more physical the work history, the harder that argument becomes for the agency to make.

Which means the least useful thing an older claimant can do is describe themselves as capable of anything at all, out of pride. The question is not whether you could manage something. It is whether you could hold it down, five days a week, at somebody else’s times.

Claims in Kettering

Kettering is large, settled and built around a medical corridor, and its population skews older than the county around it. That shows up in the work: long careers ending in injury, and disability claims from people who have paid in for decades.

Kettering is in Montgomery County, and a claim that reaches court is heard at the Montgomery County Court of Common Pleas at 41 N. Perry Street in Dayton, in the Montgomery County Courts Building.

A disability claim is federal and the county court has no part in it. An injury claim does, and Ohio generally allows two years from the date it arises to bring one (Ohio Revised Code § 2305.10). General information about Ohio law rather than advice about your own case.

Social Security hearings for this area are held by the Dayton Office of Hearings Operations, at Courthouse Plaza SW, Suite 300, 10 North Ludlow Street, Dayton, OH 45402. Its telephone number is 888-450-4590 and its fax is 833-635-0630.

Workers compensation appeals for this area are heard by the Industrial Commission of Ohio at 1242 E Dayton Yellow Springs Rd, Fairborn, OH 45324, telephone 937-264-5116.

Casper, Casper & Casper were all very professional when I had to speak with them and they made me feel just as important as everyone else's case. They helped me tremendously in a reasonable amount of time. I also was impressed how they get right to the point, no beating around the bush, I appreciate that.

Questions

Questions from Kettering

General information, not legal advice. Every case turns on its own facts. The only way to know where yours stands is to have someone look at it.

I am in my late fifties. Am I too old to bother applying?

No, and being older can make the claim easier rather than harder. The rules take account of how realistic it is for somebody with your age, education and work history to move into different work. A long, physical work history is a strength in that analysis rather than a weakness.

I have worked all my life. Does that count against me?

It counts for you. A long record of contributions is what SSDI is built on, and a long record of work is also evidence that you are not somebody who stops easily. Examiners see the opposite pattern often enough to notice the difference.

Should I just take early retirement instead?

Ask before you do. The two interact, and the order in which somebody claims can affect what they end up with. It is a question worth a phone call rather than a guess, and it is one people commonly get wrong by acting first.
